1 Introduction and Summary

1.1 SportStack is the trading name of Betvest Limited. Betvest Limited is registered in the UK, under Companies House registration number 11635965, incorporated 22nd October 2018. Registered address: 64 New Cavendish Street, London, England, W1G 8TB. Accordingly, any reference to “SportStack” or “us” shall be construed as constituting a reference to Betvest Limited.

1.2  SportStack is licensed by the British Gambling Commission (the “Gambling Commission”), with account number 54484. For Customers registered in the United Kingdom, the service is licensed and regulated by the Gambling Commission licence.  See https://secure.gamblingcommission.gov.uk/PublicRegister/Search/Detail/54484 for details of SportStack’s Gambling Commission licence.

1.3  SportStack is licensed as a Remote Betting Intermediary by The Irish Revenue Commissioners, licence number: 1016177, issued on the 28th January 2020. For customers registered in the Republic of Ireland, the service is licensed and regulated by the Irish licence.

1.4  The contractual relationship between the registered user (also known as “you”, “your”, “Customer”) and SportStack is governed by this document (“Terms and Conditions”), the Product Specific Betting Rules, our Privacy Policy, our Cookies Policy and any terms of a specific promotion (together the “Agreement”).

1.5  Opening an Account results in the acceptance of the Agreement, and each Customer is bound by them through the existence of the relationship.

1.6  SportStack reserve the right to alter or change these Terms and Conditions and Product Specific Betting Rules, at any time.

1.7  Any change to the Terms and Conditions will be notified to the Customer in advance or at the earliest reasonable opportunity. If they are material changes the Customer will be notified in advance.  If you continue to use the Platform after the date on which the changes to the Terms and Conditions come into effect, you will be deemed to have accepted those changes.

1.8  Should you no longer wish to use SportStack’s services due to a change in the Agreement you must close any outstanding Bets (to the extent possible), remove all available funds, and close your Account at the earliest opportunity.

1.9  As we expand SportStack’s offering, alternative language Terms and Conditions may be made available. The English language version shall prevail in the case of any conflict.

2 Account rules

2.1  Account holders must be aged 18 years or older in the UK or Ireland. Other jurisdictions may dictate the minimum legal age to participate in gambling activities be higher. It is your responsibility to comply with such regulations of your jurisdiction.

2.2  By opening an Account you accept these Terms and Conditions and verify that if you are a UK or Irish resident, you are over the age of 18 and acknowledge that underage gambling is an offence, or alternatively are of age to engage in gambling activities in your country of residence. We reserve the right to request proof of age from you, or conduct further verification checks as to your identity, including age.

2.3  By opening an Account, you declare that:

2.3.1  you have not self-excluded from the Platform or self-excluded via GAMSTOP;

2.3.2  you do not already hold an Account;

2.3.3  you are not opening the Account on behalf of a third party;

2.3.4  you are not and have not been in the last two years, employed or contracted by a SportStack Group Company.  For the purpose of this clause, “SportStack Group Company” shall mean SportStack, any subsidiary of SportStack, any parent of SportStack or any subsidiary of a parent of SportStack.

2.4  Each time you access the Platform you repeat the declarations at 2.2 and 2.3. 

2.5  It is your responsibility to verify that when opening an Account and conducting business with SportStack, that you are not breaching any applicable laws in your jurisdiction.

2.6  Currently only UK and Irish residents are permitted to be SportStack Account holders. This may change in due course as the company expands, but will still be prohibited in certain countries. SportStack reserve the right to refuse access to its services from any particular jurisdiction at any time.

2.7  Only one Account is allowed for each person and must be opened personally. SportStack monitor Accounts to identify any separate Accounts held by the same person. SportStack make efforts to automatically block duplicate Accounts, however we cannot guarantee that these restrictions will always block your attempts to make a duplicate Account. This may mean that in certain circumstances an individual who has entered a self-exclusion, time-out, or limit, may be able to circumnavigate our checks and create an additional Account. SportStack will maintain vigilant to these attempts, but ultimately will not accept responsibility on any losses incurred during the period that the duplicate Account(s) remain undetected.

2.8  During the registration process you will be able to choose your login email, phone number and password. You can change this password at any time by going to your Account. Login and Account details should be kept confidential. Treat them as you would your personal bank details. You remain solely responsible for the security and confidentiality of your Account. Should you forget your password, you can reset it. Should you forget login details you must contact SportStack to arrange entry – we may request additional identification for this. Where a pin-code is offered to authenticate, we recommend Customers use a different pin to others in use on that device, knowing that these can be less secure than a traditional alpha-numeric password.

2.9  All information submitted during the Account registration process must be accurate. This information includes, but it not limited to, your full name as per official identity documents, your current full residential address, your date of birth, and your personal email address/phone number. Should any information change, you agree to update your profile at the earliest opportunity, and at the latest prior to any further betting activity.

2.10  SportStack reserves the right to examine and confirm your identity beyond the minimum requirement laid out by regulatory bodies. SportStack have made efforts to streamline such checks where possible, dealing with authorised and secure third parties, but very occasionally SportStack may request that documentation proving your identity and residency is forwarded to its offices. SportStack may suspend the Account and all Account functionality, including but not limited to, Bet management and withdrawal of funds, or close your Account, should these demands not be met.

2.11  SportStack retains the right to make any queries regarding the source of any funds deposited with SportStack. Should you fail to provide satisfactory responses to our queries, SportStack may suspend the Account and all Account functionality, including, but not limited to, Bet management and withdrawal of funds. SportStack may also close the Account. SportStack may pass on such information as it deems necessary to the relevant authorities.

2.12  If a Bet is placed using your Account, the Bet will be considered to have been made by you and therefore once accepted by us, it shall be considered valid unless we consider it to contravene any other term and any losses shall be considered final.

2.13  By opening an Account you agree to abide by these Terms and Conditions at all times, and in particular that:

2.13.1  You will not act in the interest of any third-party.

2.13.2  You are not utilising funds originating from any criminal or illegal activity.

2.13.3  You are not utilising bank accounts, debit cards that you are not authorised to use. Note a deposit and withdrawal name must match the Customer’s details.

2.13.4  You will not attempt to gain unauthorised access to SportStack’s Platform or try to alter its software in any way.

2.14  You are strictly prohibited from acquiring Accounts for other Customers or transferring Accounts to or from other Customers.

2.15  You must not collude with other Customers or in any way that distorts normal game play. In accordance with SportStack’s strict AML policies, we will monitor customer activity, irregular order matching, and take action and report suspicious behaviour to relevant authorities. This may include the suspension of an Account(s) pending further investigation.

2.16  SportStack at its discretion and without having to provide justification may: refuse to open an Account; close an Account; or refuse to accept any Bet. SportStack’s decision may stem from, but not be limited to, reasonable suspicion that any Account is traced to the same address, IP address or computer. Winnings on any such Account may also be frozen, existing contractual obligations will be honoured except in the cases where we suspect the Accounts are connected with any breach of these Terms and Conditions, underage gambling, or involved in criminal acts, including money laundering.

2.17  All Accounts are opened in and all transactions are made in GBP (Great British Pounds). Additional currencies may be accepted in the future, and you will be notified of the updated terms here.

2.18  SportStack is not a financial institution and there will be no interest paid on any funds held in your Account. Furthermore, SportStack ensure all customer funds are held in a separate bank account, however they are not protected in the event of insolvency (see Clause 5.9 for more information).

2.19  It is your responsibility to keep track of winnings and report them to the appropriate authorities for taxation purposes, should you reside in an applicable jurisdiction.

2.20  In the future, we may choose to allow third-party applications to connect to SportStack. You should be aware that this may in turn not display full information about your Account or betting activity.

2.21  You may close your Account with SportStack by withdrawing all funds and emailing us at support@sportstack.com

2.22  Following termination, closure, suspension or exclusion of your Account, SportStack will in the normal course of business, return any funds in your Account and again following the settlement of any open Bets by  the last method of payment that you used to deposit funds into your Account and/or any such other method of payment determined by us (including to any other payment methods you have used to deposit).  This process may differ by Product offering and any difference will be outlined in the Product Specific Betting Rules. We reserve the right to withhold the funds in your Account from you pending the result of any investigation. This includes, but is not limited to, where we suspect you acted in breach of these terms and/or where we have to withhold funds in your Account by law to comply with a request from any governmental, regulatory or enforcement body.

2.23  Depending on the result of any such investigation we reserve the right to seize a portion or all of the funds in your Account if we are satisfied that you have acted in breach of these Terms and Condition or any other element of the  Agreement.

2.24  If we incur any charge-backs, reversals or any other charges in respect of your Account, we reserve the right to charge you for the relevant amounts incurred.

2.25  If we reasonably believe an Account to be involved in fraud, money laundering and/or any other form of illegal or suspicious activities, you shall be liable for any and all claims, losses, liabilities, damages, costs and expenses incurred or suffered by us arising as a result of or in connection with your fraudulent or otherwise illegal activities (“Claims”), and you agree to fully compensate us for any costs, charges or losses sustained or incurred by us (including any direct, indirect or consequential losses, any loss of profit and any loss of reputation) in respect of such Claims.

3 Commission and Charges

3.1  The rate of Commission charged varies by Product – please refer to the relevant Product Specific Betting Rules.

3.2  SportStack reserve the right to apply new Charges, specific to Customers or trading patterns at any time. Individual Accounts meeting the new thresholds will receive an email outlining such changes, along-side a date on which these changes take effect. Note these changes may be based on your Account’s commission charge history. If the customer chooses to continue trading after this notification, any new Bets that are placed after this notification will be settled at the new commission structure.

3.3  Accounts that relate to one person or entity are treated as belonging to one Customer for the purposes of calculating Commission and Charges.

3.4  In circumstances where SportStack is satisfied that multiple Accounts have been used by one person or group of persons in order to avoid or reduce liability for the future Charges, SportStack shall be entitled to treat those Accounts as if they relate to one person for the purposes of calculating Charges. SportStack may link those Accounts and the linked Accounts shall be jointly and severally liable for any unpaid Charge. The Charge will be debited from any such Account(s) where applicable.

3.5  SportStack will not disclose details of exactly what criteria it uses when linking Accounts. SportStack adopts very stringent and detailed forensic measures to analyse links between Accounts, thus allowing SportStack to confirm beyond reasonable doubt, where Accounts are linked for Charge purposes.

4 Inactive Accounts

4.1  An inactive Account is any Account that has been inactive for a period of twelve (12) months or more. Inactive means that you have not logged in for that period of time.

4.2  Any Account deemed to be an inactive Account will be charged an administrative fee equivalent to three Pounds (£3) per month.

4.3  SportStack will notify the Customer that an inactive Account fee shall be charged thirty (30) days prior to any fees being incurred.

4.4  The administrative fee will be charged monthly until the inactive Account either becomes active again, or the Account balance is reduced to zero (0).  A maximum of six (6) months of inactive Account fees will be charged during a single inactive period. SportStack reserve the right to forcibly close an Account(s) that is inactive for eighteen (18) months or more.

5 Deposits, transfers and withdrawals


5.1  Deposits can be made into your Account via debit card. The name on the card, or any other payment method must be identical to that of the Customer. If SportStack identifies that funds have been deposited to your Account from a third-party, we reserve the right to immediately return the deposit back to the source and void any winnings that have arisen from such a deposit. Any charges levied by the banks and/or payment gateways may be deducted by SportStack from the reversed amount. 

5.2  SportStack no longer accept deposits or withdrawals via credit card.

5.3  SportStack have a six (6) cards per twelve (12) month period usage policy.  This is in accordance with our Responsible Gambling policy. Should SportStack fail to prevent a seventh card being used to deposit due to a technical error, any Bets placed or losses incurred using these funds will still stand.

5.4  There are minimum deposit amounts which vary by payment method you choose. The specific requirements can be found on SportStack’s Minimum and Maximum Deposit/Withdrawal page. You are able to make multiple withdrawal requests to reach your desired withdrawal total.

5.5  Any funds deposited into your Account may be eligible for a transaction fee levied by SportStack according to the Minimum and Maximum Deposit/Withdrawal Page.

5.6  Any funds deposited must be used for the placing of Bets. Where you act in contradiction to this rule and request a refund of a deposit made without placing any Bets, SportStack may delay or block a refund.

5.7  Funds deposited should be used for betting purposes only, and any deposit or withdrawal activity should be paired with betting activity. In addition to the transaction fees outlined in the Minimum and Maximum Deposit/Withdrawal page, we reserve the right to off-set any fees incurred through the processing of your payments. These can be applied without notice to Accounts deemed to be abusing any of our payment methods.

5.8  Any suspicious activity on an Account may lead to the Customer being reported to the relevant authorities and freezing of the Accounts funds. Additionally, this could also lead to the closure of the Account, confiscation of funds, and withholding of funds on behalf of the relevant authorities.

5.9  SportStack is required by the Gambling Commission to inform its Customers about what happens to funds that we hold on account for you, and the extent to which funds are protected in the event of insolvency. For further information on the Gambling Commission’s approach and requirements concerning the protection of customer funds, please take the time to read their policy found at https://www.gamblingcommission.gov.uk/for-the-public/Your-rights/Protection-of-customer-funds.aspx. SportStack holds customer funds separate from company funds. These funds are not protected in the event of insolvency. This meets the Gambling Commission’s requirements for the segregation of customer funds: Not Protected.

5.10  We may at any time offset any positive balance on your Account against any amount owed by you to us (including under a duplicate Account).  Any negative balance on your Account will fall immediately due and payable to us.

5.11  A statement of your Account can be viewed when you are logged on and transactions can also be viewed. SportStack may in the future offer multiple currencies and not just GBP. Associated foreign exchange costs may therefore exist in the future, the details of which will be found on the Minimum and Maximum Deposit/Withdrawal page as and when implemented.


5.12  There is no way to transfer funds from one Account to another. We remind you that only one Account is permitted per person.


5.13  SportStack requires withdrawals to use the same method as deposit. When not possible, the Customer will be required to withdraw at least the initial amount deposited via the same method before any additional funds can be withdrawn. SportStack reserve the right to dictate the method of withdrawal, and all withdrawal requestor details must match the Customer name on registration.

5.14  There are minimum withdrawal amounts for each payment method which can be found on SportStack’s Minimum and Maximum Deposit/Withdrawal page.

5.15  SportStack will attempt to process withdrawal requests within two (2) working days from receipt of such request.

5.16  SportStack require identification/verification checks before depositing, but sometimes if the situation changes whilst you have funds on deposit, we may require additional checks prior to withdrawal. Such situation changes include depositing or withdrawing over a certain threshold, currently set at a cumulative £1,800. Additional unspecified checks are in place, but again do not centre around withdrawals, but betting activity in general.

5.17  If within fourteen (14) days of a withdrawal request being made you have failed to provided additional details we require (i.e. you have exceeded the threshold detailed in 5.16), the request will be cancelled and funds returned to your Account.

5.18  SportStack reserve the right to require additional identification/verification checks prior to the threshold detailed in  5.16 being breached.

6 Betting rules

6.1  Prior to placing a Bet(s) you should make yourself aware of the Product Specific Betting Rules. Given the nature of SportStack’s offering these betting rules may be different to other betting service providers.

6.2  A Bet can only be placed by a registered Customer.

6.3  A Bet can only be placed remotely, via an internet connection, on an electronic communication device.

6.4  There is no credit facility at SportStack. You must only place a Bet if you have sufficient funds in your SportStack Account.

6.5  Your Bet will be settled in accordance with the version of Terms and Conditions and Product Specific Betting Rules from the time the Bet is accepted, with the exception of Career Markets where the nature of the Bet means that each Bet will be judged of that version currently in force at the time when any winnings/ Dividends are paid out and/or any Shares are sold.  Please note that, in particular, that SportStack may amend Product Specific Betting Rules (including Dividend Table or Scoring Table) if there are changes to any of the below core elements and that it will attempt to make any changes in a way which correspond with changes to such core elements (e.g. if matches in a league are doubled, the Dividends in Career Markets may be halved):

6.5.1  Premier League: 20 teams to play 38 matches each totalling 380 matches across the season (plus relegation playoffs where appropriate);

6.5.2  La Liga: 20 teams to play 38 matches each totalling 380 matches across the season (plus relegation playoffs where appropriate);

6.5.3  Ligue 1: 20 teams to play 38 matches each totalling 380 matches across the season (plus relegation playoffs where appropriate);

6.5.4  Serie A: 20 teams to play 38 matches each totalling 380 matches across the season (plus relegation playoffs where appropriate);

6.5.5  Bundesliga: 18 teams to play 34 matches each totalling 306 matches across the season (plus relegation playoffs where appropriate).

6.6  A Bet is deemed to have been placed as soon as an acceptance of Bet confirmation is received on your electronic device. You can see all Bet confirmations in your account section of both the SportStack website and app.

6.7  By using SportStack’s Products, you declare that at the time of Bet placement, that:

6.7.1  you have no knowledge as to the outcome of an event;

6.7.2  you have no access to insider information;

6.7.3  the action of you placing a Bet does not breach any rules on betting or misuse of inside information relevant to a sports governing body, other professional body of which you, or your employer, is a member.

SportStack monitor Account activity and reserve the right to void Bets or withhold funds where there is suspicion of a violation of this rule. This may include measures to comply with other legal or regulatory bodies. We work closely with sports governing bodies to maintain the integrity of the sport.

6.8  In the event of any information being received by us in relation to irregular betting patterns and possible instances of event manipulation, we reserve the right, at our discretion, to:

6.8.1  suspend markets on any Events;

6.8.2  delay and/or withhold payment on any Event until the integrity of such Event has been confirmed to us; and

6.8.3  void any respective Bets if event manipulation is confirmed as having taken place.

6.9  Bets Matched or placed after the outcome of an Event may be voided at SportStack’s discretion and SportStack reserve the right to suspend a Customer(s) that place such Bets. There are specific voiding rules for each Product – these can be found in the Product Specific Betting Rules.

6.10  Sometimes a match will be stopped outside of SportStack’s control. In such situations, SportStack may suspend betting on such match and void any Bets relating to such match. Further details can be found in the Product Specific Betting Rules.

6.11  Should SportStack choose to close or restrict a Customer’s Account, open Orders that have been Matched will not be voided and you will be paid out on winnings assuming the Event is due to take place within the next 30 days. Refer to clause 13.3 of the Career Market Product Specific Betting Rules for details of how Career Market Bets due to settle in greater that 30 days are handled. These same rules apply to Customer-instigated closure or restrictions.

6.12  Unmatched Orders may be cancelled, but it is possible that an Order may already be partially or wholly matched with other Customers (or by SportStack). Once you place an Order, there is no guarantee that you will be able to amend or retract it.

6.13  Mistakes when placing an Order are wholly the responsibility of the Customer. Mistakes by a Customer do not influence the validity of the Bet. Particular attention should be paid to the direction, price and stake before placing each Order.

6.14  By placing an Order, you acknowledge and confirm that you have read and understood the Terms and Conditions and Product Specific Betting Rules.

6.15  By placing an Order you understand that only the proportion of an Order that is Matched is risked, and therefore only that proportion is subject to potential winnings. Unmatched stakes will be returned to your Account at the time of Order cancellation or Event end.

6.16  When placing an Order on the Platform you are aware that you may be betting against trading software systems or electronic pricing bots. In order to provide a better service and encourage increased liquidity, SportStack sometimes partners with liquidity providers, liquidity partners or market makers. SportStack reserve the right to provide its own liquidity, but is under no obligation to do so. Any liquidity provision may be altered or changed without notice, particularly when it comes to algorithm programming.

6.17  Slower devices or slower internet connections may adversely impact your ability to place Bets on all SportStack Product offerings.  In addition, you acknowledge that ‘live’ TV or other broadcasts are delayed and that other Customers may have more up-to-date information.

6.18  You may not use the Platform in any manner which we would reasonably consider to be ‘cheating’, which shall include but not be limited to:

6.18.1  colluding with other persons;

6.18.2  using software to gain an advantage;

6.18.3  exploiting any weaknesses within the Platform;

6.18.4  ‘courtsiding’ or any similar activity;

6.18.5  betting on sporting events which have been subject to ‘match fixing’; or

6.18.6  using insider information,

6.19  SportStack will determine available funds, pending funds, funds allocated to Bets, and appropriate commission charges as outlined by Product Specific Betting Rules.

6.20  SportStack will make every effort to ensure that liability and potential winnings (if applicable) are correct at the time of placing a Bet, but it is the Customer’s responsibility to ensure these are correct before placing a Bet.

6.21  It is your responsibility to ensure that you are betting on the specific Product, and market within that Product, that you are targeting. Take careful note of the Product you are betting on, and other Product specific details such as the opponent in Match Day Markets.  In addition, to the extent that a Bet can be managed by a Customer after it has been placed (e.g. by selling Shares in Career Markets) the Customer will be responsible for the management of such Bet.

6.22  SportStack require all Customers to Accept Price Moves to use any of SportStack’s Products. Note this acceptance only allows price or odds improvements to your Bets.

6.23  Should a better price be available than the Limit Price you have indicated on the bet slip, we will automatically match you at the better price. This follows “best price execution” practises that you may be used to on other exchanges. In such a situation your share number remains unchanged, but your potential winnings may increase, and maximum exposure decrease.

6.24  The Customer is responsible for understanding the economics of the Bet they are entering in to. SportStack will not be held responsible for mistakes with respect to a Customer placing Orders. These include but are not limited to, betting on the correct Product, the correct Event, the correct Player,  the correct market, the Stake size, the Price, or the Side of Bet.

6.25  Winnings will be paid into your Account based on the Product Specific Betting Rules. SportStack will aim to settle Bets as soon as reasonably possible after the Event is deemed over.

6.26  SportStack operate a strict one Account per person policy. Should SportStack become aware that a person has placed Bets from different Accounts, that a person has opened multiple Accounts or multiple Accounts appear to be controlled by or connected to a single person, without limitation to any other rights SportStack has under this Agreement, SportStack has the right to:

6.26.1  void all or any such Bets on such Accounts and to the extent that such Account(s) have been credited with monies as a result of such Bets, such monies shall be deemed to be held by you on trust for SportStack and SportStack may:  withdraw the relevant amount from your Account; and/or  cancel/reverse any withdrawal which you have made; and/or  to the extent that you have withdrawn such amounts, make a demand for payment for such amount and you shall then immediately repay such amount to SportStack; and/or  void any subsequent Bet placed using such monies and/or withhold any winnings which you may have won with such monies and take any action described above at,,, and/or

6.26.2  suspend and/or close:  any or all such Accounts; or  all such Accounts, with the exception of the first Account that the Customer opened and credit such first Account with the balances from the other Accounts that have been closed.

6.27  Where SportStack provides an exchange, this is done to facilitate genuine and legitimate Bets only. You agree to not bet on a market in a manner that adversely effects its integrity. You also agree not to obstruct or put in place obstacles that negatively impact SportStack’s operation.

6.28  Collusion is strictly prohibited. You are strictly prohibited from placing Bets with the intention of transferring funds to another Customer’s Account. SportStack monitor such trading activity and reserve the right to freeze Accounts and pass on details to the appropriate bodies.

6.29  SportStack publish prices and indications of liquidity on its website and app. In the event of SportStack’s back-end technical system (the system not directly visible to Customers) and front-end technical systems (the interface visible to Customers) being put of sync, the amounts and relevant calculations in the back-end are deemed final and binding. 

6.30  Unmatched Orders are available to be Matched as soon as they are placed. This applies to all Products where Unmatched Orders are supported.

6.31  Orders with a better price are matched first. Orders with the same price are matched in chronological order. The order in which Orders were received by SportStack defines the position in the queue at that price, with the exception of an Order placed by SportStack itself which may take precedence. 

6.32  Should the Product support it, amended Orders may change your Order’s position in the queue. If you change the Price, you will be moved to the back of the queue. For the avoidance of doubt, down-sized Orders (in terms of number of Shares) would maintain their original place in the queue. Up-sized Orders (in terms of number of Shares) would see your Order lose its place in the queue.

6.33  You must not act in any manner that is detrimental to the operation of the Platform, including but not limited to knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful, or attempt to gain unauthorised access to: our Platform; the servers from which our Platform is operated; or any server computer or database connected to our Platform.

6.34  You must not use programs or devices or interface with our Platform using any third-party software, including any third-party software or services (including websites or subscription services) which are designed to provide an unfair advantage or distort normal use of the Platform.  For the purpose of this clause, an "unfair advantage" means:

6.34.1  any instance in which a Customer accesses or compiles information on other Customers (including the tracking of Customers through the use of such automated software) beyond which the Customer has personally observed through the Customer’s own play (other than information or services provided to Customers directly by us); and/or

6.34.2      otherwise exploits or participates in the exploitation of a fault, loophole or error in our Platform or any third party's software, or otherwise manipulates the Platform, and uses it to our disadvantage or the disadvantage of other Customers.

6.35  SportStack may suspend activity on the Platform at its discretion, including the purchase or sale of any Share on the Career Markets Product.

6.36  It is important to acknowledge that definitions of Attributes vary between providers, and are not necessarily consistent just because both data consumers (e.g. SportStack and its competitors) source their data from the same data provider (e.g. OPTA), labelling them as the same thing. SportStack has tried to keep definitions as consistent as possible, but limitations on the speed of certain Attributes being delivered through the Data Feed we utilise will result in discrepancies. You may already notice the mis-match of data between other online providers referencing the same source. SportStack have a more accurate tooltip on some of its Attributes in the Scoring Table to assist you with our definition.

6.37  SportStack’s decision on Attributes is final. Whilst we make use of OPTA data, the exact mapping, interpretation and decision on whether or not to include incoming data is at our discretion. By placing a Bet with SportStack you are confirming that you understand this. We will not take other sources into consideration when determining the Final Points Score for each Players, so please ensure you understand our rules before placing a Bet as errors or misunderstandings cannot be rectified.

7 Errors/ Resettlement

7.1  While we attempt to ensure that the Platform does not contain errors, errors may arise.  A non-exhaustive list is set out below:

7.1.1  a Bet is accepted where you do not have enough cleared funds in your Account;

7.1.2  a Bet is accepted at odds which are obviously incorrect in the context of normal gambling and the probability of the event occurring;

7.1.3  information relating to a Bet has been incorrectly displayed on the Platform;

7.1.4  information received from a Third Party Data Provider is incorrect;

7.1.5  a Bet has been accepted on a closed or suspended market;

7.1.6  the amount of winnings, returns or promotional benefits/bonuses paid are miscalculated as a result of human error or system error;

7.1.7  winnings are so obviously incorrect or materially different to those available in the market that it is a clear error or omission;

7.1.8  a Bet has been settled, but it becomes necessary to re-settle the Bet because a result changes (including when a result has been recorded and/or published incorrectly by SportStack);

7.1.9  an error or technical issue with the Platform (including a technical error, such as an error which prevents access to the Platform);

7.1.10  a Bet has been accepted in circumstances which breaches the Agreement.

7.2  In the event of an error on the Service:

7.2.1  you must notify us of any error, to the extent you become aware of such error, and not take advantage of such error;

7.2.2  SportStack reserves the right, but is not obligated, to:  correct any consequent error on a Bet and settle it accordingly (or re-settle such Bet if it has already been settled); or  declare an affected Bet void and return the Bet stake to your Account,

7.2.3  to the extent that your Account has been credited with monies as a result of an error, such amounts shall be deemed to be held by you on trust for SportStack and SportStack may:  withdraw the relevant amount from your Account; and/or  cancel/reverse any withdrawal which you have made; and/or  to the extent that you have withdrawn such amounts, make a demand for payment for such amount and you shall then immediately repay such amount to SportStack; and/or  void any subsequent Bet placed using such monies and/or withhold any monies which you may have won with such monies and take any action described above at, or in relation to such subsequent Bet.

8 Data usage

8.1  OPTA, owned by Perform Group, provide data for SportStack/act as a Third-Party Data Provider. In the future SportStack may use data feeds offered by other providers. Under no circumstances can you copy, redirect or distribute the data provided on our website or app.

8.2  Whilst every care has been taken to select the most appropriate data sources, the manual nature of data collection means that the process itself is open to reporting errors and from time to time inaccurate relay of information. SportStack accepts no responsibility for such mistakes and will aim to rectify errors in accordance with section 7 above and as soon as we are notified by a Third-Party Provider.

8.3  Refer to the Product Specific Betting Rules for details on when Player data will be considered for change or deletion. The precise rules vary by Product. This may result in re-settlement of Bets in favour of or against you as a Customer. SportStack will remain as independent as possible in the decision making, and endeavour to communicate in a timely manner.

8.4  SportStack relies on OPTA reporting for both pre-play (such and team sheet and player position) and in-play (such as assists and goals) Attributes. SportStack accept no responsibility for errors, corrected or otherwise, and will settle Bets according to the information at our disposal as per the Product Specific Betting Rules.

8.5  The “Collection End” marks the point at which SportStack cease to interpret new or amendments to existing Attributes, subject to rules regarding “High Scoring Attributes” which permit SportStack to reconsider certain Attributes after the Collection End.  These rules vary by Product – please see the Product Specific Betting Rules for detail.

8.6  Should the reference point for settling Bets on a Product cease to exist, or the definition of “Collection End” meaningfully change, SportStack will use an alternative that it deems to have similar characteristics. 

8.7  The reporting of information is subject to delay and the displayed information on either our website or app may be not be accurate at the time you place your Bet. It is your responsibility for ensuring the state of the Event at the time you place your Bet.

9 Responsible gambling

9.1  SportStack are committed to operating in a responsible way.  

9.2  SportStack allow Customers to set their own limits on betting and deposit sizes during specified periods of time. This limit can be removed by you through the Account function, but only after the user-specified time period elapses.

9.3  SportStack allow Customers to have a ‘time out’ for the following durations, and these cannot be cancelled or shortened once entered in to:

9.3.1  24 hours

9.3.2  one week

9.3.3  one month

9.3.4  such other reasonable period, up to a maximum of 6 weeks.

9.4  SportStack operate a cooling off period on certain self-imposed account limits. This covers deposit limits. Seven (7) days must pass from the time at which the Customer has asked for a relaxing of such user-specific rules, before being able to adopt the new ones.

9.5  A Customer can self-exclude via the Platform (by accessing their Account and the accessing the ‘Responsible Gambling’ section) or by contacting SportStack by email.  All Customers have the right to self-exclude themselves from betting on the Platform for a minimum period of 6 months and for a maximum period of 5 years. This period can be extended by a further 6 months. No cooling off period is required to enter into a period of self-exclusion. During this time of self-exclusion it is not possible to reopen your Account. Self-exclusions will persist for a minimum of 7 years after the end of the period selected by a Customer, unless a Customer takes steps to reactivate their Account. Reactivation of a Customer’s Account whose term of exclusion has passed is subject to a one (1) day cooling off period. Reactivation of the Account must be done over the phone, if you email our customer services team we can arrange such a call. You cannot reactivate your Account on the app or website.

9.6  If a Customer has self-excluded, we will take all reasonable steps as soon as practicable to ensure marketing material is not being sent to that Customer.

9.7  Details of a Customer who has entered into a period of self-exclusion are retained in order to ensure the period of self-exclusion is fulfilled.

9.8  SportStack also participate in the national multi-operator self-exclusion scheme (GAMSTOP). After you have self-excluded with GAMSTOP, you will be prevented from gambling with SportStack until your GAMSTOP self-exclusion is no longer active.  Your GAMSTOP self-exclusion may take a number of days in order to become active with us, after you register with GAMSTOP.  In this period, you must not access the Services and we shall not be liable if you do.  You must ensure that the details you use to register with GAMSTOP are the same as those details registered on your Account, if they are not the same your self-exclusion may not become active with us.

9.9  SportStack take responsible gambling very seriously. If you try and open duplicate Accounts with SportStack during a period of self-exclusion we will attempt to detect and close them. If, however, you are able to access our Platform, any losses incurred during the period prior to detection will not be refunded.

9.10  Any withheld winnings detailed in Clause 9.9 may be donated to a responsible gambling charity of SportStack’s choosing.

9.11  SportStack have a six (6) cards per twelve (12) month period usage policy. This is in accordance with our Responsible Gambling policy. Should SportStack fail to prevent a seventh card being used to deposit due to a technical error, this will be a breach of these terms and SportStack reserves the right to take any action  described at clause  16 below or to permit any Bets placed to stand, with any or losses incurred using these funds to also stand.

9.12  SportStack have a Responsible Gambling Policy which we encourage all Customers to read regularly.

9.13  According to the Gambling Commission’s Social Responsibility Code Provision 3.1.1.(2), all “licensees must make an annual financial contribution to one or more organisation(s) which between them research into the prevention and treatment of gambling-related harm, develop harm prevention approaches and identify and fund treatment to those harmed by gambling". SportStack make this donation to GamCare.

9.14  For more information on responsible gambling, or for help or counselling, Customers are directed to the GamCare website: https://www.gamcare.org.uk, or similar sites.

10 Intellectual property

10.1  SportStack and its logo are trademarks of SportStack. Any unauthorised use of the brand and/or the logo of SportStack could lead to legal prosecution by SportStack.

10.2  All content found on the Platform (including and SportStack’s app), sportstack.com, associated URLs, is owned or licensed by SportStack. Unauthorised reproduction of this content could lead to legal prosecution.

10.3  The term SportStack is trademarked under both UK (IPO) and European (EUIPO) trademark licensing.

10.4  No part of our Platform may be reproduced, stored, modified, copied, republished, uploaded, posted, transmitted, distributed, transferred or exploited, by any means or in any manner, or included in any other website or any other public or private service including text, graphics, video, messages, code and/or software without our express written consent.

10.5  Any commercial use or exploitation of the Platform or its content is strictly prohibited.

11 Liability

11.1  Nothing in these Terms shall exclude or limit our liability:

11.1.1  for fraud;

11.1.2  for death or personal injury resulting from our negligence; or

11.1.3  to the extent such liability cannot be excluded or limited as a matter of law.

11.2  Subject to clauses 11.1.1 - 11.1.3, and save in respect of any winnings lawfully due to you in accordance with this Agreement, our maximum liability to you in relation to any one incident or series of related incidents is limited as follows:

11.2.1  where such liability relates to a specific Bet which you have placed, the value of the respective stake paid by you;

11.2.2  where such liability relates to the misapplication of funds in your Account, the amount that has been lost or misplaced;

11.2.3  where such liability relates to any other liability of SportStack (i.e. which is not covered by clauses 11.1, 11.2.1, 11.2.2, our maximum liability shall be one thousand pounds (£1,000).

11.3  Subject to clause 11.1, we (and/or our third-party services providers, to the extent relevant) shall not be liable to you:

11.3.1  in contract, tort (including negligence), breach of statutory duty or otherwise arising for loss of profits, loss of revenue, loss of business, loss of data, loss of business, loss of business information, business interruption, loss of reputation, loss of opportunity, or loss of goodwill, or for any indirect, special or consequential loss;

11.3.2  for any loss or damage that you may suffer because of:  any act of god;  power failure;  trade or labour dispute;  any act, failure or omission of any government or authority;  obstruction or failure of telecommunication services or networks;  cyber-attack;  terrorist attack;  pandemic or epidemic;  any other act, omission, delay or failure caused by a third party or otherwise outside of our control;

11.3.3  for any loss or damage that you may suffer because of the use of our Platform which breaches these Terms and Conditions, including any losses you may incur if you continue to use the Platform after you have self-excluded, whether directly or via GAMSTOP, in particular where:  you have sought to circumvent a self-exclusion via an additional Account;  you have changed any of the registration details in your Account or opened a new Account;  you have continued to gamble with us between your self-exclusion registration with: (i) GAMSTOP and us receiving notification and applying such self-exclusion to our Platform (ii) us and us applying such self-exclusion to our Platform;  the operating systems utilised by GAMSTOP fail to properly and/or in a timely manner identify you and/or your Account(s) as subject to self-exclusion.

11.4  Our liability to you is limited to the proportion of your loss or damage which either we agree, or is found by a court to be just and equitable, after taking account of the contribution to the relevant loss and damage of any other person responsible and/or liable to you in respect of that loss or damage.

11.5  SportStack is not responsible for the external services, pages or contents that may be linked from the SportStack website or app.

11.6  An event as described at 11.3.2 could lead to a complete or partial reduction in service offered on all electronic mediums supported by SportStack. In such events SportStack may at its sole discretion choose to cancel or suspend some or all of the services offered without incurring liability.

11.7  SportStack is not to be held responsible for any consequences caused by the breakdown of any software or hardware either directly managed or outsourced. This includes breakdowns limiting or preventing access to some or all of its services.

11.8  SportStack accepts no responsibility to you or a third party arising directly or indirectly from a mistake, misprint, malfunction of software provided by SportStack. The denial of responsibility also applies to mistake, misprint, malfunction of software on any of its affiliates and/or partners.

12 Privacy Policy

12.1  Your privacy is paramount to SportStack. Additional details can be found in our Privacy Policy.

12.2  Anonymised betting information may be shared with a Third Party Provider(s), but we shall not share your personal identifiable details.

12.3  You agree to receiving marketing communication from SportStack. Methods and frequency of communication can be altered in your account settings, as well as app notification settings on your phone/tablet.

12.4  All personal information that you share with SportStack will be kept securely and may be transferred to relevant authorities. We reserve the right to supply your details to authorised credit reference agencies or identity verification companies.

12.5  SportStack will use personal information and other information collected on you to provide customer support and undertake security and identity verification checks.

12.6  SportStack will retain all information for the time set out by applicable legislation. Regulators may also direct time requirements. You are able to contact SportStack and ask us to erase any or all of your information, but the request will only be answered if it is compliant with applicable law or regulator.

12.7  SportStack use certain browser cookies to improve the customer experience. These cookies aim to improve your experience and will not interfere with your privacy. You can consult our Cookie Policy to learn more about how you can manage them.

12.8  We reserve the right to share your personal information in the occurrence of a company event such as take over, merger or other disposition.

13 Technical difficulties

13.1  From time to time technical difficulties may be encountered, resulting in unscheduled downtime to both the Website and App. This may leave you unable to manage open Bets. You can contact customer support to clarify your position.

13.2  Once an order to place a Bet has been placed on a SportStack Product, there is no guarantee that the Customer can cancel or amend an order.

13.3  Your order is deemed to be placed as soon as it has been processed by SportStack’s servers. We aim to provide Customers with an acceptance message quickly, however in exceptional circumstances there may be a delay or not be one. In such a situation, the Customer should go to their account page for clarification, and if not there, they should contact customer support.

13.4  An order received on our servers are deemed final, even if there is a break in communication notifying you. Equally, orders that are not received by our servers will not register, and the stake will not be taken from your Account balance. If you are unsure of your position do not make more Bets, contact support immediately.

14 Complaints

14.1  SportStack takes complaints seriously. We want Customers to enjoy their time on the Platform, but if you are dissatisfied at the quality of our offering we have a complaints procedure for you to follow.

There are two levels of complaints– Complaints Co-ordinator and Lead Contact of SportStack.

Level 1 – Complaints Co-Ordinator

If we haven’t reasonably met your expectations or you wish to make a complaint relating to services you should write or e-mail in the first instance to the Complaints Co-ordinator: support@sportstack.com. Please put in the subject line ‘FAO: Complaints Co-ordinator’.

In expressing a concern it is helpful to include all relevant details such as nature of complaint, date, people contacted and the other circumstances relating to your complaint. This helps to quickly and fully understand the nature of the complaint and begin investigations. Once the Complaints Co-ordinator acknowledges receipt of your letter or email in writing within 48 hours, he/she will also provide a copy of this complaints policy. You can normally expect a full written response within 10 working days of this acknowledgement. His/Her aim is to resolve the complaint to your complete satisfaction at this level.

Level 2 - Lead contact of SportStack.

If, after receiving our response at the 1st level you feel that your concerns have not been fully addressed you can ask for your complaint to be referred to the lead contact in relation to SportStack. Please contact support@sportstack.com.  Please put in the subject line ‘FAO: Complaints Lead Contact’. You can normally expect a full written response to your complaint within 10 working days of acknowledgement of the complaint reaching the 2nd level.

It may be necessary for additional information to be sought from an external source. When this is necessary, it may not be possible to respond to your complaint within 10 working days and the Lead Contact will contact you again. He/She will explain the reasons for asking for a time extension and seek your approval.

14.2  On the rare occasion that a dispute cannot be resolved between SportStack and Customers, Customers can contact Promediate who are our third-party adjudicators in all disputed matters. All contact with Promediate is carried out in writing and an adjudication request must first be requested. The Promediate service is free for you the Customer. 14.3  If you live in an EU country or in Norway, Iceland or Liechtenstein, you may also use the European Commission’s Online Dispute Resolution platform available here instead of contacting Promediate directly. However, by doing so you will be directed to Promediate and this may prolong the dispute resolution process. 

15 Terms for Promotions

15.1  The following terms apply to all promotions as standard. There will be additional terms per specific promotion, that will be accompany the promotion.

15.2  Promotion participants must be over 18 years old. Underage Bets will be voided.

15.3  Promotions are made available once per individual. SportStack reserves the right to withhold any promotional benefits it suspects may have arisen from linked Accounts.

15.4  By entering a promotion, you agree to these terms, as well as any promotion specific terms.

15.5  Any promotions that involve sharing referral codes and encouraging persons signing up to benefit you as an existing Customer will be subject to fair use constraints. SportStack reserve the right to terminate a specific Customer’s benefits from such a scheme if they believe that the process of promotion that is being carried out are not in the best interest of SportStack. This may involve noticeable patterns of play, bonus abuse, or terminology used when promoting SportStack. Benefits already paid out, but are subsequently deemed to be ineligible, are recoverable by SportStack.

15.6  Promotions are a privilege and SportStack’s decision on promotional matters are final.

15.7  Email, SMS and push notification promotions will only be available to Customers who directly receive them from SportStack. Promotions are not necessarily shareable or forward-able.

15.8  Promotions are non-transferable and not necessarily sharable with other Customers.

15.9  No account restrictions will be enforced against you after you have made one or more qualifying Bets as part of a Free Bet Promotion (defined at 15.10 below), where enforcing such account restriction would:

15.9.1  affect your ability to:  receive the free bets, or the full expected value of the free bets from that Free Bet Promotion, having placed all the necessary qualifying bets;  place the remaining qualifying bets required by that Free Bet Promotion and consequently receive the free bets, or the full expected value of the free bets from that Free Bet Promotion, to which you would be entitled as a result;  complete any betting requirements associated with that Free Bet Promotion; or

15.9.2  materially affect your ability to complete the qualifying bets required by that Free Bet Promotion.

15.10  For the purpose of clause 15.9, "Free Bet Promotion" means a promotion where a bonus is added to your Account specifically for betting on sports, including bonuses (i) in the form of a free bet of a fixed value or (ii) in the form of funds with a value linked to the amount of a deposit which is subject to wagering requirements.

16 Breach of the Agreement

16.1  If we have reason to believe that you are in breach of the Agreement or if we are required to do so by law, we reserve the right, at our reasonable discretion, to:

16.1.1  suspend your Account or specific elements of your Account; and/or

16.1.2  close your Account; and/or

16.1.3  void any Bet; and/or

16.1.4  cancel any withdrawals; and/or

16.1.5  withhold your Account balance; and/or

16.1.6  recover from your Account the amount of any affected pay-outs, bonuses and winnings; and/or

16.1.7  require that any amount which was won and/or withdrawn in breach of the Agreement is returned to us; and/or

16.1.8  require that any amount which was won and/or withdrawn, if required by law or court order, is returned to us or forfeited to a third party; and/or

16.1.9  implement a permanent ban from our Platform.

16.2  You agree to compensate us for any costs, charges or losses sustained or incurred by us (including any direct, indirect or consequential losses, any loss of profit and any loss of reputation) arising in relation to a breach of the Agreement.

16.3  You agree that we may use monies in your Account (and/or any duplicate Account) to settle any liabilities we may incur as a result of your breach of the Agreement.

17 Miscellaneous

17.1  Should one or more of these terms be deemed void, the remaining terms remain valid.

17.2  The terms in the Agreement supersede and replace any previous written or verbal agreements between us.

17.3  We may transfer our rights or obligations or sub-contract our obligations under the Agreement to another legal entity.  You agree that we may do so provided that this will not adversely affect the standard of services you receive. In the case of transfer only, after we notify you of the date on which we will transfer our rights and obligations to another legal entity, your only rights under or in connection with the Agreement will be against the new legal entity and not against us.

17.4  This Agreement is personal to you. You may not transfer your rights or obligations under the Agreement to anyone else.

17.5  If you breach the Agreement and we take no action against you, we will not be deemed to waive our rights in relation to such breach and shall still be entitled to use our rights and remedies in relation to such breach or any other situation where you breach the Agreement.

17.6  Should there be any conflict between the Terms, Rules and specific terms of a promotion, the order of precedence shall be as follows:

17.6.1  the specific terms of a promotion;

17.6.2  the Product Specific Betting Rules; and

17.6.3  these Terms and Conditions.

17.7  If we need to notify you under the Agreement, we will do so by email to the email address registered to your Account.

18 Governing Law and Jurisdiction

18.1  The Agreement are governed by and interpreted in accordance with the laws of England and Wales.

18.2  Disputes arising in connection with the Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales subject to any statutory rights you have in respect of using the courts of Scotland or Northern Ireland.
